American Express and Diners Cards now accepted

4 November 2009

From 1 November 2009 the Land and Environment Court will accept American Express and Diners cards in addition to Mastercard and Visa for the payment of all filing fees.

International Framework for Court Excellence

28 September 2009

As a result of its continuing participation in the International Framework for Court Excellence, the Court has developed a Statement of Purpose that sets out the Court’s aims and the methods by which it will achieve those aims. The Statement reflects the seven areas of court excellence identified by the International Framework.

Mining decision

28 May 2009

The decision in Alcorn v Coal Mines Australia Pty Ltd given on 21 May 2009 by Mr J Bailey, A/LCM, concerns a review of an arbitrator's decision relating to access agreements pursuant to the Mining Act 1992.

Court Attire Policy

5 May 2009

On 1 May 2009 the Chief Judge issued a new Court attire policy. The policy applies also to proceedings in Class 8 of the Court's jurisdiction.

Mining jurisdiction

27 March 2009

From 7 April 2009, the Land and Environment Court will have jurisdiction to hear and dispose of proceedings under the Mining Act 1992 and the Petroleum (Onshore) Act 1991. The Court will be establishing a separate practice collection to assist parties, including self represented litigants, by providing a wide range of information about the Court’s new mining jurisdictions

Planning Principle set aside

12 March 2009

The judgment in Double Bay Marina Pty Ltd v Woollahra Municipal Council [2009] NSWLEC 1001 at [47]-[52] which proposed a planning principle, concerning discerning the public interest in development applications, has not been adopted by the Court and will not be published on the Court's website as a planning principle of the Court.
