Practice Note for Class 3 Aboriginal Land Claims

The Chief Judge has issued a Practice Note for Class 3 Aboriginal Land Claims. The Practice Note commences on 10 December 2012.

Changes to Registrars' list

As of 15 January 2013 the face-to-face Registrar's list (Tuesday-Friday) will commence at the earlier time of 9:00am.

Appointment of Agents in the LEC

Section 63 of the Land and Environment Court Act 1979 has been amended by the Courts and Other Legislation Amendment Act 2012 to remove the right of a person to appear by an agent authorised in writing and instead now requires a person to apply for leave from the Court to be represented by an agent.  The amended s 63 came into force on 28 October 2012 by proclamation. The amended s 63  applies to proceedings commenced after the date of commencement (28 October 2012).   For proceedings already commenced before the amendment, the unamended s 63 applies.

2011 Annual Review

The Court's 2011 Annual Review has now been published and is available online. The review provides an overview of the Court and reports on the Court's achievements in 2011, including how the Court has performed against key performance indicators.

Practice Note for Class 5 Proceedings

The Chief Judge has issued a Practice Note for Class 5 Proceeding. The Practice Note commences on 12 November 2012.

Law vacation 2012-13

14 September 2012

The Judges' fixed vacation begins on 14 December 2012 and the first day of term in 2013 will be Tuesday, 29 January 2013.

Matters may be listed for s 34 conferences, mediations and hearings before Commissioners throughout the fixed vacation except for the public holidays of Monday 25 and Tuesday 26 December 2012, Tuesday 1 and Monday 28 January 2013.

The final Registrar's directions hearing list for 2012 will be on Wednesday 19 December 2012.  

The Registrar's directions hearing list will resume on Monday 14 January 2013.  A return of subpoena list will be held on Wednesday 9 January 2013.

A Duty Judge will be available during the vacation for urgent matters.

Filing fees

Court fees have been increased as a result of amendments to the Civil Procedure Regulation 2005 and the Criminal Procedure Regulation 2010. The new fees are effective from 1 July 2012.

New case management procedures for class 5 criminal matters   

The Criminal Procedure Amendment (Summary Proceedings Case Management) Act 2012 was passed by Parliament on 13 March 2012 and received assent on 21 March 2012. It is scheduled to commence operation on Monday 30 April 2012.

The object of the Act is to amend the Criminal Procedure Act 1986 to make provision for case management procedures to reduce delays in trial and sentencing proceedings before the Supreme Court and the Land and Environment Court in their summary jurisdiction. Amongst the measures the courts may make are orders requiring that certain disclosures be made by the prosecution and the defence before a trial or sentencing hearing.

The Land and Environment Court will shortly release a Practice Note for Class 5 matters to reflect the provisions of the Act.

Court Appointment

The Hon. David Henry Lloyd QC has been appointed as an Acting Judge of the Court for the period commencing on 5 March 2012 until 4 May 2012.
