Land and Environment Court of NSW

Aboriginal land claims - At the pre-hearing mention

The List Judge at the third directions hearing may direct that the pre-hearing mention take place if the matter is particularly complex or is expected to exceed three days hearing time. The purpose of the pre-hearing mention is to ensure readiness for hearing and to give directions to facilitate the just, quick and cheap resolution of the appeal.

The pre-hearing mention will be held on the second last Friday before the hearing and before the hearing judge, if possible. Counsel or solicitors briefed to appear at the final hearing are expected to attend.
